So the email I sent to the property fell back to “We will review this and get back to you.” I immediately knew that the property has gotten their lawyers involved.
The property manager called me today, basically starting that their lawyers are recommending I settle where we vacate the apartment we are in now, get out of our lease, but at the same time, I would have to sign a release that states that the property is not liable for damages.
I started laughing. Told her nobody in their right mind would blindly sign something like this due to the nature of what happened. I immediately told her that we would be signing absolutely nothing. That since the property decided to take this route, and not satisfy the simple requests I’ve made, realistically it’s < $5,000 I was asking for. That I’ll have to hire an attorney and they will continue this conversation. She knew right then and there to get off the phone ASAP. She then asked about the other unit if I wanted them to hold it or release it, I immediately told her that since they want to go the legal route, and make us pay to move, make us pay for mold testing with the new apartment, etc, sorry you can shove that apartment up your ass.
I’m sorry, but with what I said in that email is 100% fact. No embellishments. Being completely transparent. But since they want to interpret this transparency, and not do the right thing, I’ll have no choice but to seek legal council regarding the damages they caused directly to me, and Anies. I’m not going to take their response lightly. They know they are on the hook for certain damages.
What a fucking joke
Let’s just think this “agreement” out. We concede liability for the damages to our health we’ve easily incurred the past 3 years. That board has been rotten since we have moved in. Never would I have thought it was toxic. Nonetheless, they would let us out of the lease, allow us to apply for the new apartment. That’s it.
They gain everything, and I’ve lost easily 3 years of my life, several ER visits, hospitalizations, surgeries are the direct result of their failure to uphold the warranty of habitability clause within the lease.
They are 100% liable for a considerable sum of money. Had they done the right thing, we wouldn’t be here, but here we are.
I’ve still yet to see this “agreement” they want us to sign, but that won’t happen. I can easily get out of the lease with the clause in the lease. As for damages and whatnot, I’ll need to contact an experienced attorney that has experience with this type of matter.
I can definitely tell you that we will be moving out of here. This all depends on what my attorney tells me. There are still levels of mold in the apartment. Not as bad as it was, but to be frank, it’s not 0. I can guarantee you that when it comes time to renew our lease, that they will kindly decline to offer a renewal. It’s within their right, but they also can’t kick us out without cause. This would also be considered retaliation.
So basically this starts the long hard road of finding a new place. We definitely need to get out of here.
